Terms of Service

1. Who we are

Kiniage ("Kiniage", "we", "us") is a private home for a family's photos and family tree. Kiniage is incubated by Metro Point Technology. These Terms of Service ("Terms") are an agreement between you and us about your use of Kiniage.

2. This is a free beta test

Kiniage is in an early beta test. It is provided free of charge to invited and volunteer beta testers so that we can test it and improve it with your feedback. You are not paying for Kiniage during the beta.

Because it is a beta: features may change, break, be removed, or be unavailable at any time; there may be errors; and data may be lost.

UPLOAD COPIES ONLY. During the beta, upload only COPIES of your photos and keep all of your ORIGINALS on your own computer or other storage. Do not rely on Kiniage as your only copy of anything, and do not delete an original because it is in Kiniage.

We may end the beta, reset beta data, or move to paid plans. If we do, we will give you reasonable notice where we can and a chance to download your content first.

3. Your account

You must be at least 18 years old to create an account. Keep your password private; you are responsible for activity under your account. Tell us if you think your account has been misused.

4. Your content belongs to you

Your photos, descriptions, notes, family tree information and conversations with Kin ("your content") belong to you and your family. You can download everything at any time in standard formats. Your original photos are stored unchanged.

You give us permission to store, process and display your content only as needed to run Kiniage for you and the family members you choose to share with, and to keep it safe. We do not sell your content or your personal information.

Nothing in Kiniage is public. Sharing is only with family members you choose, one by one.

You confirm you have the right to upload the content you add, and that it doesn't break the law or anyone else's rights.

5. Acceptable use

Use Kiniage lawfully and respectfully. Do not upload illegal content. Child sexual abuse material is strictly prohibited; we use automated detection and report it to the authorities as the law requires. Do not try to access other people's accounts or data, disrupt the service, or use it to harass anyone.

We may remove content or suspend accounts that break these Terms, usually after a warning when a report is received.

6. Kin and other AI features

AI features, including Kin, are optional and can be switched off at any time; everything in Kiniage can also be done without AI. AI suggestions (for example, a suggested date or description) can be wrong. Please check them before relying on them.

7. Feedback

As a beta tester you contribute by giving feedback. You agree we may use your feedback to improve Kiniage without any obligation to you.

8. No warranty ("as is")

To the fullest extent permitted by law, Kiniage is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and without any promise that it will be uninterrupted, error-free, or that data will not be lost.

9. Beta release of liability

BECAUSE KINIAGE IS PROVIDED FREE AS A BETA TEST, YOU AGREE, TO THE FULLEST EXTENT PERMITTED BY LAW, TO RELEASE KINIAGE, METRO POINT TECHNOLOGY, AND THEIR OWNERS, EMPLOYEES AND AGENTS FROM ANY CLAIMS, LOSSES OR DAMAGES ARISING FROM YOUR PARTICIPATION IN THE BETA OR YOUR USE OF KINIAGE, INCLUDING LOSS OF DATA OR CONTENT, AND YOU AGREE NOT TO BRING ANY SUCH CLAIM AGAINST THEM.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, and our total liability for any claim relating to the beta will not exceed zero dollars (US$0), reflecting that the beta is free.

You agree to hold harmless and indemnify Kiniage and Metro Point Technology from claims by others arising from content you upload or your breach of these Terms.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for gross negligence or willful misconduct, or rights you have as a consumer that cannot be waived where you live.

10. Ending your use

You can stop using Kiniage and ask us to delete your account at any time. We may suspend or end your access if you break these Terms or if the beta ends.

11. Changes to these Terms

We may update these Terms. If a change is material, we'll ask you to agree to the new version before you continue using Kiniage.
